1. Acceptance of Terms

By accessing or using the NFT Image Builder service (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

NFT Image Builder provides tools for creating generative NFT image collections. Users can upload trait images, configure rarity weights and exclusion rules, generate unique image combinations, and download collections with associated metadata. The Service supports both static (PNG) and animated (GIF) image formats.

3. Account Registration

  • You may register using email/password, Google, GitHub, or a Solana wallet.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information and keep it up to date.
  • You may not create multiple accounts to abuse free credits or promotions.
  • You must be at least 13 years old to use the Service.

4. Credits & Payments

  • The Service operates on a credit-based system. New accounts receive free credits upon registration.
  • Additional credits can be purchased using SOL (Solana) cryptocurrency.
  • Credits are non-transferable and non-refundable unless a generation fails, in which case credits are automatically refunded.
  • Credit prices may change at any time. Purchased credits remain valid regardless of price changes.
  • We are not responsible for fluctuations in cryptocurrency value.

5. User Content

  • You retain ownership of all images and content you upload to the Service.
  • You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.
  • You represent that you have all rights necessary to upload and use the content you provide.
  • You may not upload content that infringes on others' intellectual property rights.
  • You may not upload illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable content.

6. Generated Output

You own the generated NFT images and metadata created using your uploaded content. We claim no ownership over your generated output. However, we do not guarantee the uniqueness, marketability, or value of generated NFTs.

7. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or servers
  • Use automated scripts to access the Service without permission
  • Impersonate another person or entity
  • Upload malicious files or code
  • Circumvent any access controls, rate limits, or credit systems

8. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We are not liable for any modification, suspension, or discontinuation.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NFT IMAGE BUILDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

11. Indemnification

You agree to indemnify and hold harmless NFT Image Builder, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users or the Service. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
